Commercial quantity is defined in Section 2(viia) NDPS Act -“commercial quantity”, in relation to narcotic drugs and psychotropic substances, means any quantity greater than the quantity specified by the Central Government by notification in the Official Gazette.
Adv. Ravindhar answers during the webinar, It is only Section 37(1)(b) that speaks of special limitations in grant of bail vis a vis certain offences under the NDPS Act. Offences under Sections 19 or 24 or 27A and also offences involving commercial quantity are governed by the special provisions stipulated in Section 37(1)(b) with regard to the grant of bail.
Adv. Ravindhar answers during the webinar, such an offence under Section 20(b)(ii)(C) is 10 years which may extend to 20 years with a fine of Rs. 1 lakh which may extend to Rs. 2 lakhs.
